Terms of Use for Daydream Lane Pixels Members Area
General
- As someone who is not very organized, I'm proud to say
that I do have my graphics very well sorted. This isn't a requirement, but I
recommend that if you already do not have a file system set up, try these
tips, okay? Go into your "My Documents" folder and create a new folder
titled "Graphics". Then within that folder, create a folder for each one of
the membership sites that you belong to (and any other graphic sites that
you frequently visit). So, now that you have a folder named "Daydream Lane
Pixels", inside that, create folders for "Tubes", "Lines", "Goodies",
"Personal Use Websets" and "Commercial Use Websets". Inside the "Tubes"
folder, create sub-folders for each of my tube sections, such as "Flutter
Faery Hollow". Now, when you download anything, you will know just who
to credit and even save little notes about terms. I created this page so it
would be easy for you to copy and paste this into your notepad and save it
as a text file. That way, when you are busy creating, you don't have to look
too far to find the terms for this site. I hope this helps someone.
- Everything contained in this website is copyright either to myself
and/or to my licensors listed HERE. Nothing
within the Members Area or the main site is public domain. Use of these
graphics require a link back to
http://www.daydreamlane-pixels.com whenever used. You are not
to share your login information or any material from this site in any manner
not included in your membership subscription. You may never offer anything
from in any type of collection or for sale on a CD.
- When you purchase a membership to the site, you are only purchasing the license
to use the artwork in the manner described in these Terms Of Use. You are
NOT purchasing
the copyright to anything here. The copyrights are retained by the original artists
(myself and those whom membership sites I am licensed to utilize).
- You do not have to have a website in order to join. If
you do have a website/s, please do include the url/s in your application and
place your member logo on it within 7 days of subscribing. Your website
should be completely copyright compliant. If your site has illegal graphics,
please do not apply (this includes any type of site you run on the web). If
you have a membership site, I do not require guest access unless you require
it of your members or if I have reason to be concerned that my terms are not
being followed. If you have a website, please use protection scripts.
- Your understanding of these terms of use is assumed whether you have
read them or not. Please note that any term violation may result in your
subscription being voided without refund. I have honestly read
http://www.copyright.gov/ several
times and do know my legal rights as a graphic artist. I reserve the right to terminate
your membership without refund and have you cease and desist using any of
the work obtained from this site if I have found you to be violating my TOU.
- You may NOT claim sole credit to any of the work.
- You must join my updates group at
http://tech.groups.yahoo.com/group/DaydreamLane_Updates.
- Please do not hotlink. Please save your items to your own hard drive.
- If and when I offer lifetime memberships, they will be for the lifetime
of this site.
- There are no refunds once you enter with your login.
- If your membership expires, you may continue to use the work you
obtained during your membership as long as you continue to link back to the
site and credit the work properly.
- I reserve the right to refuse service, sell to or offer membership to
anyone. This applies even if you win a membership.
- You may not use any of the work for or on a site that promotes hatred,
bigotry of ANY kind or pornography. This includes who you sell to, so please
make sure to follow up.
- Have fun and be creative.
- These terms can change at any time without notice (though I am the kind
of girl that would probably tell you LOL).
- You may definitely recommend this site to your friends by giving them a
link. If they mention your name when they join, you just might get a little
referral present.
Tubes From My Memberships
- These tubes were created using line art from my memberships. You are
licensed to use them as a member for end use only. That means you must
create something with the tubes to use them. Please make sure you do more
than just adding text.
- You can use these tubes to create sig tags, websets, WordPress themes,
premade adoptions, wallpapers, and email stationery for personal or for
profit use.
- You may not offer the tubes as they are or use them in any type of
scrapbooking projects as that goes against the TOU for some of my
memberships.
- You many not recolor or alter them in any manner.
- They may not be used in any As-Is projects.
- If you have any questions about what is and is not allowed,
please ask
me. I'm very easy to talk to. :)
Daydream Lane Originals
- Line Art: You are allowed to tube my line art for your membership area as long as they are
colored in. There is not a separate tube license for this at this time. It
is included in your membership. You may not alter them or take them apart.
You may not redistribute them as-is in any manner.
- Tubes: These are for end use only and are not to be used As-Is. You may
create websites, WP themes, sig tags, premades, adoptions, email stationery
and wallpaper for personal or for profit use. Anything else, please request
permission first. You may not make line art from my tubes. You may change
the eye color.
Personal Use Websets
- These websets are created for my members to use on their own personal
websites whether they are personal or commercial sites.
- They may not be taken apart or distributed for any reason.
- You must request one so I can put the text on the header first, but you
may add text to the banners and buttons.
- Please do not combine websets. If you need something extra,
just ask and
I'll see what I can do.
Commercial Use Websets
- These websets are created for my members to use for their own personal
or commercial sites and for them to use to create websites for others. As a
member, you are licensed to use each webset
3 times: once for yourself and
twice for clients. Any member violating these terms will have their
membership revoked and will no longer be allowed to use any work from
Daydream Lane Pixels. If members continually violate the terms for these
websites, the section will be removed.
- At this time, there is no special license for this section and it is
included in your membership price. This WILL change. Those current members
will be grandfathered in when that happens.
- You may not combine websets, take them apart or distribute them other
than creating a site for a client.
- If you wish to convert a webset into a WP theme, you may do so only if
you allow me to offer it to the other members with additional credits to you
using these same exact terms.
- I do not add text to these or install these for your clients. That part
is your responsibility.
- The images used to create these websites are either copyright to me or I
am licensed to use the graphics.
- You are to use my sample images for your website or to show to your
client.
- Your client must agree to keep the credits and scripts intact.
- I am really hoping this section works out. I'm excited about it and I
hope that the honor system with using each set only three times works out.
Goodie Section
- Backgrounds: These backgrounds can be used for personal or for profit
use. No mass distribution is allowed.
- IncrediMail Stationery: These letters are created for member use only.
Please do not use these IM stats in snag groups.
- Scrap Stuff: Anything in here is for your personal use. No commercial
use is allowed unless otherwise noted. Please do not share these with anyone
until after you have made your pages.
- Sig Tags: Members can request up to 3 sig tags per week. Please keep
credits intact and link back to
http://www.daydreamlane-pixels.com/.
- Wallpaper: These are for your personal use only and may not be shared
with anyone.
